To celebrate the 10-Year Anniversary of the Texas Tuition Promise Fund® (TTPF or Plan), NorthStar Financial Services Group, LLC, the Plan manager of TTPF, is giving away TTPF tuition units to select accounts meeting the eligibility and enrollment requirements in the Texas Tuition Promise Fund® Giveaway Official Rules.

Summary Highlights of the Giveaways

For a limited time, you could qualify for a giveaway of either $300 or $500 in the form of tuition units by opening a new account that meets eligibility and enrollment requirements.

$500 Giveaways

  • Five (5) $500 Giveaways will occur each month for the months of December 2018, January 2019, and February 2019 (the Promotion Period).
  • $500 Giveaways will be given to the first five (5) purchasers in each month of the Promotion Period who open an account meeting eligibility and enrollment requirements. See Official Rules for details.

$300 Giveaways

  • One (1) $300 Giveaway will occur each month for the months of March 2019, April 2019, May 2019, June 2019, and July 2019 (the Newborn Enrollment Period).
  • A $300 Giveaway will be given to the first purchaser in each month of the New Enrollment Period who opens an account meeting eligibility and enrollment requirements. See Official Rules for details.

General Information About the Giveaways (see the Official Rules for complete details)

  • To be eligible, an account must be the first-ever TTPF account established for the named beneficiary.
  • The TTPF account must be established online at www.texastuitionpromisefund.com during the Giveaway periods noted below.
  • Enrollment will be considered complete upon online payment of the $25.00 application fee and a system assigned TTPF account number at completion of enrollment.
  • A Giveaway period begins at 12:01 am CT on the first calendar day of each month in the Giveaway period and ends at midnight CT on the last calendar day of that month.
  • Purchaser and beneficiary must be eligible for enrollment in TTPF.
  • Accounts selected for the Giveaways must meet all eligibility and enrollment requirements of the Plan and the Giveaway.
  • All Giveaways will be in the form of TTPF tuition units, not cash.
  • The type of tuition units given away will be determined by the tuition unit type chosen by the Purchaser of the selected account when the selected account was established.
  • The Plan will identify the selected accounts to receive Giveaways within ten (10) business days following the close of each month. Giveaway recipients will be notified within ten (10) business days of deposit of tuition units into the account.
  • TTPF tuition units will be deposited into the selected account within fourteen (14) calendar days after selection and verification.
  • The Plan reserves the right to close and refund an account or disqualify an account for purposes of a Giveaway if account information is incomplete, false, or misleading, if the administrative fee is returned unpaid, or if the plan is unable to verify the identity of the Purchaser or named Beneficiary of the selected account.



TEXAS TUITION PROMISE FUND® GIVEAWAYS

Official Rules
November 10, 2018 through July 31, 2019

GENERAL INFORMATION: The Texas Tuition Promise Fund® Giveaways are part of a celebration to recognize the 10-Year Anniversary of the Texas Tuition Promise Fund, the State of Texas’ prepaid tuition plan. The initial Giveaway begins on November 10, 2018, at 10:00 a.m. or later Central Time (CT). Additional Giveaways will occur each month of open enrollment for the months of December 2018, January 2019 and February 2019. Newborn Giveaways will occur each month of newborn enrollment for the months of March 2019, April 2019, May 2019, June 2019, and July 2019. The Giveaways are funded by NorthStar Financial Services Group, LLC, the plan manager of the Texas Tuition Promise Fund®.

ELIGIBILITY: The Giveaways are open to individuals who are eligible to establish an account in the Texas Tuition Promise Fund (called the “Texas Tuition Promise Fund” or the “Plan”) for a named Beneficiary (the “Purchaser”). There can be only one eligible Giveaway entry per named Beneficiary. If the named Beneficiary is a Texas resident, a Purchaser can be any U.S. citizen or legal resident 18 years of age or older who opens an account in the Texas Tuition Promise Fund. If the named Beneficiary is not a Texas resident, a parent of the named Beneficiary who is a resident of Texas must be the Purchaser. To be eligible for the Giveaways, it must be the first-ever account established in the Plan for the named Beneficiary.

THE GIVEAWAYS: The Giveaways will be in the form of Texas Tuition Promise Fund tuition units (“Tuition Units”), not cash. The value of each Giveaway will be either $1,000 or $500 or $300. Tuition Units given away will be based on the value of the Giveaway and the type of Tuition Units the Purchaser chose when the selected Plan account was established. For example, if the Purchaser selected Type II Tuition Units when the account was established, a $500 Giveaway would equal 4.905 Type II Tuition Units. This amount is calculated by dividing the $500 Giveaway by $101.95 (the 2018-19 Plan enrollment year cost of each Type II Tuition Unit) and rounding the result to the nearest three digits. In that example, a total of 4.905 Type II Tuition Units would be deposited to the account selected for the Giveaway. The following chart shows the number of Tuition Units that will be given to the selected accounts:

THE INITIAL GIVEAWAY: One (1) Giveaway valued at $1,000 (the “initial Giveaway” or “$1,000 Giveaway”) in Tuition Units, not cash, will be given to an attendee of the 10th Anniversary Meet Your Future Celebration of the Texas Tuition Promise Fund (the “Celebration”). To be selected, a Celebration attendee must open an eligible, first-ever Plan account for the named Beneficiary online. The Celebration will be at Mueller Browning Hangar, Austin, Texas on November 10, 2018. (Location, date, and/or time of the Celebration are subject to change. Any changes will be noted on the Plan’s website, at www.texastuitionpromisefund.com.) The $1,000 Giveaway will be given to the first Purchaser completing online enrollment using a code (the “Code”) provided to attendees at the Celebration. Codes will only be available at the Plan’s exhibit table during the Celebration. Enrollment is complete upon online payment of the Plan’s $25.00 administrative fee and assignment of an account number by the Texas Tuition Promise Fund at completion of the online enrollment process.

To be eligible for the $1,000 Giveaway, the Code received at the Celebration must be entered during the online enrollment process. To enter the Code, follow these instructions:

  1. In Step 8 of 11 - Additional Information, select “Other” under the question, “How did you learn about the program?”
  2. Enter the Code in the blank under the statement “If other, please specify.”

Additionally, the online enrollment must be completed at or after 10:00:00 a.m. CT on November 10, 2018 and before midnight on February 28, 2019 to participate in the $1,000 Giveaway. The $1,000 Giveaway will be given to the first person to enroll who meets the eligibility and enrollment requirements, based on the date and time of enrollment, as determined by the Plan. The time will be determined down to the millisecond (00:00:00.000) by the Plan’s automated enrollment system. In the event of a tie – that is, online enrollment meeting the eligibility and enrollment requirements was completed on the same date at the same time for more than one eligible account – the person with the lowest sequentially assigned account number will be selected as the recipient of the $1,000 Giveaway.

ADDITIONAL GIVEAWAYS: Additional Giveaways, in the amount of $500 each, payable in Tuition Units, not cash (“$500 Giveaways”), will be given away each month for the months of December 2018, January 2019, and February 2019 (the “Promotion Period”). For this purpose, a month begins at 12:01 a.m. CT on the first calendar day of that month, and ends at midnight on the last calendar day of that month. $500 Giveaways will be given to the first five (5) Purchasers in each of those months (“Selected Accounts”) meeting eligibility and enrollment requirements. No later than ten (10) business days after the end of each month in the Promotion Period, the Plan will identify the Selected Accounts. The first five (5) Purchasers will be determined based on the date and time online enrollment was completed, including online payment of the $25.00 administrative fee and assignment of a Texas Tuition Promise Fund account number. The date and time of online enrollment completion will be determined solely by the Plan. The time will be determined down to the millisecond (00:00:00.000) by the Plan’s automated enrollment system. In the event of a tie – that is, online enrollment was completed on the same date at the same time for more than one account meeting the enrollment and eligibility requirements in these Official Rules – the person with the lowest sequentially assigned account number will be selected as the recipient of the $500 Giveaway. If fewer than five (5) eligible accounts are established in any month, the total Giveaways will be less than five (5) for that month.

NEWBORN GIVEAWAYS: Giveaways in the amount of $300 each, payable in Tuition Units, not cash (“$300 Giveaways”), will be given away each month during the months of March 2019 through July 2019 (the “Newborn Enrollment Period”). For this purpose, a month begins at 12:01 a.m. CT on the first calendar day of each month of the Newborn Enrollment Period, and ends at midnight on the last calendar day of that month. A $300 Giveaway will be given to the first Purchaser in each of those months (“Selected Accounts”) meeting eligibility and enrollment requirements. No later than ten (10) business days after the end of each month in the Newborn Enrollment Period, the Plan will identify the Selected Account. The first Purchaser will be determined based on the date and time online enrollment was completed, including online payment of the $25.00 administrative fee and assignment of a Texas Tuition Promise Fund account number. The date and time of online enrollment completion will be determined solely by the Plan. The time will be determined down to the millisecond (00:00:00:000) by the Plan’s automated enrollment system. In the event of a tie – that is, online enrollment was completed on the same date at the same time for more than one account meeting the enrollment and eligibility requirements in these Official Rules – the person with the lowest sequentially assigned account number will be selected as the recipient of the $300 Giveaway. If fewer than one (1) eligible account is established in any month, there will be no $300 Giveaway for that particular month.

How to Enter Each Giveaway: Visit www.texastuitionpromisefund.com and follow the instructions to open a new Texas Tuition Promise Fund account.

How Will I Know if I Received a Giveaway? The Purchaser of an account receiving a Giveaway will be notified by postal mail or by email of the Giveaway by the Plan within ten (10) business days of deposit of the Tuition Units in the account receiving the Giveaway. After verifying that accounts meet eligibility and enrollment requirements, the Plan will post notice on the “Enroll in the Plan” page at www.texastuitionpromisefund.com/content/enroll-in-the-plan advising when Giveaway recipients have been selected for each giveaway period. Because Texas Tuition Promise Fund accounts are confidential by law, the names, addresses, beneficiaries, account numbers, and other confidential information of the individuals receiving Giveaways will not be published or made available to the public.

IMPORTANT INFORMATION

Before deciding to enroll in the Plan, non-residents of Texas should consider whether it is preferable to enroll in the Plan or a 529 plan in their home state or the Beneficiary’s home state, as some states offer state residents state tax or other state benefits, such as financial aid, scholarship funds, or protection from creditors that are only available for participants in that state’s 529 plan.

The Tuition Units will be deposited into the accounts receiving a Giveaway within fourteen (14) calendar days after selection and verification. If an Account receiving a Giveaway is closed and/or refunded in full or not in compliance with either these Official Rules or the Texas Tuition Promise Fund Plan Description and Master Agreement before the Tuition Units are deposited, the Giveaway will be forfeited. At its discretion, the Plan may select the next account meeting the selection criteria to receive the Giveaway. The Plan reserves the right to close and refund an account or disqualify an account for purposes of a Giveaway if account information is incomplete, false, or misleading, if the administrative fee is returned unpaid, or if the Plan is unable to verify the identity of the Purchaser or named Beneficiary of the account receiving a Giveaway.

Recipients of a Giveaway agree that taxes, if any, related to the Giveaway are fully the responsibility of the Purchaser of the account receiving a Giveaway. When applicable, NorthStar Financial Services Group, LLC (“NorthStar”), the Plan manager that is funding the Giveaways, shall report the Giveaway to the Internal Revenue Service (“IRS”) on IRS Form 1099.

The Texas Tuition Promise Fund accounts are governed by the Texas Tuition Promise Fund Plan Description and Master Agreement. This document is available on the Plan website at www.texastuitionpromisefund.com. Please read this document before enrolling in the Plan.

In no event will the State of Texas, the Texas Prepaid Higher Education Tuition Board, its staff, employees, or agents, or NorthStar or its affiliates be responsible or liable for damages or losses of any kind arising in connection with the Giveaways. By participating, each Purchaser agrees to hold harmless the State of Texas and the Texas Prepaid Higher Education Tuition Board, and/or its officers, agents, employees, representatives, contractors, assignees, and/or designees, and NorthStar and its affiliates from any and all liability, actions, claims, demands, or suits, and all related damages, costs, attorneys’ fees, and expenses to the extent caused by, arising out of, or resulting from any acts of God, information system failure, negligence, intentional torts, willful misconduct, personal injury or damage to property, and/or otherwise related to the Giveaways. The Plan reserves the right to cancel, modify, extend, or suspend the Giveaways at any time if it determines that fraud or technical problems, system failure or malfunctions, lack of funds, or any causes beyond the Plan’s control make continuation of the Giveaways impractical, as determined by the Plan.

Each Purchaser agrees that the Giveaway shall be governed by, and construed in accordance with, the laws of the State of Texas. The venue of any suit brought for any alleged breach related to the Giveaways is fixed in any court of competent jurisdiction of Travis County, Texas. The State of Texas and the Plan do not waive any defense of sovereign immunity.

These Official Rules may be amended in writing in accordance with law by a duly authorized representative of the Texas Comptroller of Public Accounts on behalf of the Texas Prepaid Higher Education Tuition Board.

The fact that a particular provision in these Official Rules is held to be void or unenforceable under any applicable law in no way affects the validity of other provisions and the Official Rules will continue to be binding on the Plan, each Purchaser, and each named Beneficiary (the “Parties”). Any provision that is held to be void or unenforceable will be interpreted by the Parties or the courts to be replaced with language that is as close as possible to the intent of the original provision so as to effectuate the purpose of these Official Rules. Any ambiguous or conflicting terms shall be interpreted and construed in such a manner as to accomplish the purpose of these Official Rules.

Any information provided to the Texas Prepaid Higher Education Tuition Board or its staff or NorthStar and its affiliates through participation in the Giveaway is governed by the Texas Tuition Promise Fund Privacy Policy available at www.texastuitionpromisefund.com/content/tips-tools/forms-materials.

Members of the Texas Prepaid Higher Education Tuition Board and their immediate family members, Comptroller employees and their immediate family members, and NorthStar or its affiliates’ employees and their immediate family members are not eligible to receive a Giveaway. Family members include parents, stepparents, brothers, sisters, stepbrothers, stepsisters, grandparents (including great), step-grandparents, grandchildren, children (includes children’s spouses), stepchildren, foster children, foster parents, aunts, uncles, nieces, nephews, first cousins, step-aunts, step-uncles or step-cousins.

The Giveaways are void where prohibited by law. The Giveaways are subject to all applicable federal, state, and local laws.
